DPP appeals sentence

The Director of Public Prosecutions John Champion S.C. has lodged an appeal against the sentence imposed on a man who murdered his wife.

Brian Browning pleaded not guilty to the murder of his wife. Browning was sentenced in the Supreme Court to 18 years’ imprisonment with a non-parole period of 14 years.

Mr Champion has appealed the sentence to the Court of Appeal on the ground that the sentence was manifestly inadequate, with the particulars including that the sentencing judge “failed to have sufficient regard to features of the offending that made this a grave example of murder”.

These included the fact this was an unprovoked attack on his wife who was asleep in her bed at the time of the attack and was therefore vulnerable and completely defenceless.
