DPP appeals sentence

The Director of Public Prosecutions John Champion S.C. has lodged an appeal against the sentence imposed on a man found guilty of aggravated burglary, theft and causing injury recklessly to two men.

Shane Scott Bowden pleaded guilty in the County Court to one charge of aggravated burglary, one charge of theft and two charges of causing injury recklessly.

On 18 November, 2015 Bowden was sentenced to three years and nine months’ imprisonment with a non-parole period of two years and four months.

Mr Champion has appealed the sentence to the Court of Appeal on the grounds of manifest inadequacy and specific sentencing error, with the particulars including that the sentencing judge “failed to have sufficient regard to the maximum penalties for the offences, in particular the aggravated burglary and theft offences”.
