Sentence appeal for dangerous driving causing death

The Director of Public Prosecutions has filed an appeal against the sentence imposed on a man found guilty of dangerous driving causing the death of a 19 year-old girl.

Stephen Sismanoglou pleaded guilty in the County Court to one charge of dangerous driving causing death and two charges of dangerous driving causing serious injury following a vehicle collision on St Kilda Road, St Kilda, about 4.30 pm on 1 January, 2014.

The court heard Sismanoglou, who was 19 at the time of the collision, changed lanes, lost control of his vehicle and collided with a car being driven by a 19-year-old girl. She suffered severe life threatening injuries and died in hospital 10 months later. Two other passengers were in her car, with one suffering serious hip, leg and pelvic injuries.

On 26 October 2015, Sismanoglou was sentenced to a total of 21 months’ imprisonment and a two-year Community Correction Order.

DPP John Champion S.C. has appealed the sentence on the ground that it is manifestly inadequate.
