DPP appeal allowed by High Court

Director of Public Prosecutions Kerri Judd QC has welcomed the High Court’s unanimous decision to allow her appeal against a Court of Appeal decision that a trial judge could invite a jury to reach a not guilty verdict prior to having heard all of the evidence, counsel’s final addresses and the judge’s charge.

The High Court held that this type of direction, commonly referred to as a ‘Prasad Direction’, is contrary to law and should not be administered to a jury in a criminal trial.
