DPP appeals sentence for manslaughter

The Acting Director of Public Prosecutions Brendan Kissane QC has lodged an appeal against the sentence imposed on a man for manslaughter.

Angelo Russo pleaded guilty in the Supreme Court to the manslaughter of David Calandro, who was shot while sitting in his ute with his two young sons at Russo’s farm in Tatura East.

He was sentenced to five years imprisonment with a non-parole period of two years and six months.

The DPP has lodged an appeal on the basis that the sentence imposed is manifestly inadequate and that the learned sentencing judge erred in characterising the offence as ‘falling towards the lower end of the spectrum of gravity.
