DPP appeals sentence for workplace injury

The Acting Director of Public Prosecutions has lodged an appeal against the sentence imposed on a Shepparton-based packing company for failing to provide a safe work environment, which led to an Irish backpacker being scalped by a conveyor belt in a pear packing shed.

The company, Kalafatis Packing Pty Ltd, pleaded guilty in the Shepparton Magistrates’ Court to one charge of failing to provide safe plant and a single charge of failing to provide a safe system of work. Both charges were in breach of the Occupational Health and Safety Act 2004.

On 11 January this year, the Court sentenced Kalafatis Packing to a without conviction fine of $50,000.

The Acting DPP, Gavin Silbert QC, lodged the appeal on the basis that the sentence imposed was manifestly inadequate.
