Media Release - 26 March 2008 - Statement by the Director of Public Prosecutions Concerning Television Series 'Underbelly'

The Victorian Court of Appeal today dismissed General Television Corporation's (Channel 9) appeal against orders made by Justice Betty King prohibiting the publication, broadcasting or exhibition of the 'Underbelly' television series in Victoria until after the trial of 'A'.

Although the Court amended the orders made by Justice King to limit their operation to Channel 9, the Court said that any person who with knowledge of the orders sought deliberately to frustrate their effect could be liable for a contempt of court.

The Director of Public Prosecutions, Mr Jeremy Rapke QC, warned that he would not hesitate to take action against any persons who deliberately published any part of Underbelly, no matter how they obtained them.

"It is extremely important that nothing is done which could affect A's ability to receive a fair trial. I urge all Victorians to heed the stern warning contained in the judgment of the Court of Appeal and to refrain from publishing or exhibiting the series or any part of it, until the completion of A's trial", he said.
